Doorstep Debt Collection
Abacus 365’s Certified Enforcement Agents can visit your debtors and attempt to facilitate a dialogue with them to arrange payment or a payment arrangement without undertaking court action and take photos of assets/vehicles and check to see if litigation would be prosperous for the creditor.
All of our agents will act in a professional and business-like manner, and will provide a report based on their findings, including any information given during interviews held on site, information and photos on any potential assets. This service is available for business to business and for recovering funds/goods from employees that have absconded with company property.
Business to Business
The “Late payment of commercial debts regulations 2013” allows you as a business to charge a business debtor interest and (reasonable) recovery costs. Abacus 365 would charge an agreed percentage of the debt depending on various factors, such as age, size, and complexity of recovery. You would also be responsible for any related fees, such as court fees and process serve costs.
One of our highly trained and professional bailiffs will visit your debtor’s business and speak to the most senior member of staff to initiate recovery proceedings. They will also take photos of assets and vehicles for preparation should the debtor not pay within 7 days.
Commercial Rent Arrears Recovery
As a commercial landlord you have the right to use Certified Enforcement Agents to execute warrants without the need to go to court. This process is known as CRAR.
Abacus 365 can only collect rent arrears and any interest plus VAT. Our enforcement agents can also start a Controlled Goods agreement, which would deny any other enforcement agents from claiming debts upon those goods. This process can only be performed on purely commercial premises, not mixed or residential properties.
Coronavirus update to CRAR
From the 24th of June 2021, currently 554 days rent must be outstanding before CRAR can be enforced. This will likely be in effect until 26th March 2022, afterwards the standard CRAR procedure can relied upon.
Fly Grazing
Fly grazing is becoming more of an issue than ever before, with horses dumped in industrial estates and alongside roadside grassy verges. These animals are not maintained and left to cause problems with businesses and traffic.
The Control of Horses Act 2015 gives landowners the ability to instruct bailiffs to detain horses who are on their land without lawful authority. The bailiff must report the detention of the horse to the Police and to the horse owner (if known, following Section 7C of the Animals Act)
Owners of the Horse have 4 Business Days to claim their horse and must pay for the cost for the detention and transport, otherwise said Horse may be sold or disposed via humane destruction, or given to a charity if a suitable space is available.
Squatter Eviction
If you have a property that has been occupied by squatters, then Abacus 365’s team of Certified Enforcement Agents can assist you with the legal removal of such unwanted tenants. We understand that squatters can do massive costly damage to premises, which can drive down the price of your land/property. Once a High Court Writ has been issued, we can begin the removal proceedings, changing locks, installing security such as steel screens for windows and doors to prevent any further damage or theft on your property.
